Ceist:

20 Mr. E. Byrne asked the Minister for Health the proposals, if any, he has to introduce enduring power of attorney legislation allowing competent persons to appoint a particular individual to make a decision on their behalf in relation to treatment withdrawal in the event of their entering a state of permanent unconsciousness; if he intends putting advance directives, or so-called living wills, on a statutory basis; and if he will make a statement on the matter. Limerick East): I presume the Deputy's question arises from a recent High Court judgment. I understand that the judgment is now the subject of an appeal to the Supreme Court which will be heard next month.

The High Court judgment raised a number of issues which are under consideration within my Department. However, I feel that pending the Supreme Court's decision on the matter, it would be inappropriate for me to comment further.
