Ceist:

42 Mr. O'Donoghue asked the Minister for Health the proposals, if any, he has to introduce legislation to make the consumption of a controlled drug a criminal offence. [8520/95]

Limerick East): I do not accept that it is necessary to make the consumption of a controlled drug a criminal offence under the Misuse of Drugs Acts, 1977 and 1984.

I would point out to the Deputy that, under section 3 of the Misuse of Drugs Act, 1977, it is an offence for a person to have a controlled drug in his possession, without an appropriate licence or other authority under the Act.

As the Deputy is aware, in order for a person to consume a controlled drug it would be necessary that it be in their possession. It is suggested that it would be very difficult to enforce a provision in respect of consumption in view of the need of the individuals concerned to be caught in the act. I am advised that it is more appropriate to continue to deal with the matter via the offence of unlawful possession.
