Written Answers. - Rubbish Skips Safety Markings.

71 Ms F. Fitzgerald asked the Minister for the Environment if he will consider introducing regulations to oblige owners of rubbish removal skips to fit reflectorised markings to such skips in view of the danger they pose to motorists and cyclists. [16979/95]

Section 72 of the Roads Act, 1993, gives extensive powers to road authorities to make by-laws to regulate and control skips on public roads. Such by-laws may, inter alia, specify requirements in relation to the lighting and marking of skips for the purpose of making them readily visible to road users. A decision to make such by-laws is a matter for the elected members of individual road authorities.

Under the Waste Bill, 1995, commercial waste collection will require a local authority permit. Conditions attached to a waste collection permit may include requirements in relation to the receptacles, including skips, to be employed, and the identifying marks to be displayed on them. The Bill provides for the marking of regulations by the Minister for the Environment specifying conditions that may or shall be attached to a waste collection permit. The question of reflectorised markings will be considered in that context.
