164 Mr. Deasy asked the Minister for Agriculture, Food and Forestry if he will use his discretion in cases where ear tags are missing on the date of inspection in respect of cattle premia where it is clear that no fraudulent act is intended such as in the case of a person (details supplied) in County Waterford. [18758/95]

The herdowner concerned applied under the November 1994 ten month beef premium scheme in respect of 26 animals. At an inspection of his herd on 9 January 1995 four animals were missing ear tags. Under the terms and conditions of the beef premium scheme no payment can be made where it is found at inspection that an animal has lost its ear tag. Payment issued to the herdowner in respect of 22 animals but it is regretted that no payment can be made on the four animals which had no ear tags at inspection.
