Ceist:

254 Ms F. Fitzgerald asked the Minister for the Environment the Acts and provisions of Acts under the auspices of his Department which, as of 1 January 1996, are not in force in view of the fact that a commencement order has not been made; whether it is proposed to make such an order in each case; and if so, when. [19411/96]

Environmental Protection Agency Act, 1992.

Sections 93, 102 and 103 and the First Schedule.

The First Schedule to the Act is being commenced (for both new and established activities) on a phased basis. This process is ongoing and will be completed as soon as possible. There are no immediate plans to commence the other sections.

Local Government (Water Pollution) Act, 1977.

Section 25.

None.

Air Pollution Act, 1987.

Sections 9 (part of), 20, 21 22, 23 and 25.

None.

Local Government Act, 1994.

Sections 12, 18, 24, 34, 59, 63 and 68 (2); and Parts IV and V together with associated repeals.

This Act is being commenced on a phased basis as the necessary preparatory work is carried out. Section 34 and regulations under this section will be brought into operation following a general review of policy on the public library service which will be undertaken during 1996.

Control of Dogs (Amendment) Act, 1992.

All.

Commencement is being considered in the context of a comprehensive review of dog control regulations.

Local Government Act, 1955.

Section 5 for the purpose of the repeal of Section 26 of the Local Government Act, 1941 and Section 39 of the Local Government Act, 1946.

None.

Local Government Act, 1991.

Parts V and VI and Section 54 (a) together with associated repeals.

The commencement of these provisions will be considered in the light of proposals arising from the review of town local government being carried out under Part X of the Local Government Act, 1994.

Road Traffic Act, 1961 amd Road Traffic Act, 1968.

Section 93 of the Road Traffic Act, 1961 as amended by Section 61 of the Road Traffic Act, 1968.

It is intended to commence this section later this year.

Road Traffic Act, 1994.

Sections 4 (part of), 25, 35, 36 and 49 (1) (j).

With the exception of Section 25 it is intended to commence these provisions as soon as comprehensive new traffic and parking regulations have been finalised

Housing Act, 1966.

Section 115.

There are no plans to commence this section as there are broader provisions in relation to voting by local authority elected members in the local government Acts.

Housing Act, 1988.
