Written Answers. - Swimming Pool Sanction.

49 Mr. B. O'Keeffe asked the Minister for Education the reason a letter of sanction dated 29 September 1995 addressed to the Assistant City Manager of Cork Corporation sanctioning a tender for the erection of a swimming pool complex was withdrawn and subsequently replaced with a further letter of sanction dated 23 October 1995, from which the first condition relating to access to the site through Rossbrook residential estate had been deleted. A grant of £2.5 million was allocated by my Department under the major sports capital programme to Cork Corporation for the provision of a regional sports centre, including a swimming pool, at Bishopstown in Cork.

A letter issued from my Department on 29 September 1996 authorising Cork Corporation to accept a tender for the construction of the building. This letter outlined the terms and conditions for the payment of the grant and sought confirmation from Cork Corporation, as client for the project, that the contractor had access to the construction site through the adjoining Rossbrook housing estate. This confirmation was sought as Cork Corporation had identified this road for access to the site in the late 1980s when planning for the project commenced and the tenders for the project included access to the site through this estate.

As the question of access to the site was the subject of legal proceedings between Cork Corporation and the residents of Rossbrook estate, Cork Corporation was not in a position to give the confirmation sought. Cork Corporation, based on legal advice received, requested that this condition be withdrawn. As the access to the site was essentially a matter between Cork Corporation and the residents and as my Department's main concern was to ensure that the project proceeded to construction without further delay, a revised letter of sanction was issued on 23 October 1995.
