Ceist:

299 Mr. Ellis asked the Minister for Agriculture, Food and Forestry the current position in regard to lands on which there is unidentified turbary rights in respect of REP scheme applications; and the current position in regard to applicants who own land where others hold unspecified turbary rights. [10400/96]

The position on the eligibility for REPS payment of lands subject to unidentified turbary rights is that where the REPS applicant holds the turbary rights then he/she may apply for payment on the entire area provided he/she does not engage in commercial turf cutting in the area and additionally provided the scheme's conditions, particularly in relation to the retention of wildlife habitats, are observed.

In relation to lands on which others have turbary rights the position under REPS is that the turbary area must be identified by the REPS planner and excluded from payment. Where this is done, and subject to all other conditions of the scheme being met, payment can be made on the remaining land area.
