Wallace asked the Minister for Transport, Energy and Communications the current position regarding the draft Statutory Instrument for the salaried staff scheme which was being drafted in November 1995 and was awaiting a separate order by him with regard to a necessary amendment thereto; and if he will make a statement on the matter. Wallace asked the Minister for Transport, Energy and Communications the current position regarding the amendments to the CIÉ pension schemes for regular wages staff and salaried staff; the current position regarding the order made by him in November 1995 in relation to amendments to the scheme for regular wages staff; the sequence of events following the legal and technical difficulties which emerged with the order which he signed in November 1995 and the follow-up new scheme revoking and replacing that scheme which was submitted to him by CIÉ; whether he has made the order with regard to the new scheme; if so, the current position in this regard; and if he will make a statement on the matter. I propose to take Questions Nos. 310 and 311 together.

Amendments to the CIE pension scheme for regular wages staff was confirmed by me on 1 May 1996. Following legal and technical difficulties with the previous order in November last, a new scheme revoking and replacing the scheme was submitted to me by CIE. As required by statute, CIE were required to advertise the scheme and allow a 28 day period for objections. Objections were received and considered, and no modifications were made to the scheme.

As regards amendments to the salaried staff scheme, the draft amending schemes have been submitted to me by CIE. Clarification on a number of issues was sought by CIE and these are in the process of being considered by officials in my Department and in the Department of Finance. When these issues are clarified, I should be in a position to make the necessary order.
