Written Answers. - Air Navigation (Fees) Order, 1995.

Ceist:

314 Mr. S. Brennan asked the Minister for Transport, Energy and Communications whether he has approved the Air Navigation (Fees) Order, 1995; if so, the factors that justified the new changes; and if he will make a statement on the matter. [12729/96]

Under the Irish Aviation Authority Act, 1993, the Irish Aviation Authority is empowered to make Orders relating to its functions. The Act requires the Authority to inform the Minister of its intention to make any such Orders and of the purpose of the Orders. The prior approval of the Minister to the making of the Orders is not a requirement under the Act.

The 1995 Order which the Deputy refers to, with the Air Navigation (Fees) (Amendment) Order, 1996 (S.I. No. 49 of 1996) which amended the 1995 Order, was made by the Authority under Section 60 of the 1993 Act. This section specifically empowers the Authority to make Orders prescribing fees payable to it in respect of the statutory regulatory services which it provides.

All Orders made by the Authority under the 1993 Act are required, under section 6 of the Act, to be laid before each House of the Oireachtas as soon as may be after they are made. Section 6 provides that any such Order can be annulled if a resolution annulling the Order is passed by either such House within the subsequent 21 sitting days on which the House has sat after the Order is laid before it.

In the case of the Order to which the Deputy refers, no such resolution was proposed or passed.
