567 Mr. Sargent asked the Minister for Justice the reason trading at the side of the road is forbidden to some persons but not to others in view of the large amounts of trading carried out in areas which are causing a traffic hazard. [15038/96]

The Casual Trading Act, 1995, provides for the control and regulation of casual trading. In accordance with the provisions of the Act, the Minister for Enterprise and Employment may make regulations in regard to the classes of selling specified under the Act and licences to engage in casual trading are issued by the local authorities. Roadside trading which does not comply with the casual trading legislation may become the subject of a prosecution under the above mentioned Act.

All complaints made to the Garda Síochana concerning roadside trading which causes a traffic hazard are investigated. Where the trading causes a hazard to traffic a prosecution for obstruction under the road traffic legislation may be appropriate.
