55 Kathleen Lynch asked the Minister for Tourism and Trade the proposals, if any, he has to place the requirements of the EU Regulation and Council decision regarding export controls on dual use goods on a statutory basis, including the mandatory provision of a formal end-use certificate where there are grounds to believe that the proposed dual use export may be used in the development of conventional weapons; and if he will make a statement on the matter. The EU Regulation and Council Decision regarding the Control of Exports of Dual Use Goods entered into force in all EU member states on 1 July 1995. The Regulation empowers member states to request a statement of end-use and to impose other conditions concerning the end-use and/or the re-export of goods for which an export licence has been requested. Such powers are already contained in the Control of Exports Act, 1983 and the orders made thereunder, together with provisions for penalties for non-compliance with export licensing requirements. This national legislation continues to remain in force pending the making of amending orders designed to bring our national controls into full conformity with the EU system and with more recent developments in other international export controls fora. I expect to be in a position to sign these orders shortly.
