I refer to the reply to Question No. 192 of 15 October 1996. Because of the internal market as well as environmental implications involved, the legal basis for participation by EU member states in the Basel Convention is governed by a Community instrument, i.e. Regulation 259/93. The 1995 amendment to the Basel Convention is being addressed by a new EU regulation, on which a common position has been adopted and whose formal adoption is awaited.
When the required amending EU legislation is in place, arrangements will be made for ratification by Ireland of the 1995 amendment to the Convention.
