Ceist:

145 Dr. O'Hanlon asked the Minister for the Environment his policy in relation to the provision of local authority rehousing for a partner with dependent children in the event of separation after marital breakdown; and if he will make a statement on the matter. [19092/96]

Eligibility for local authority housing is determined by housing authorities on the basis of assessments of housing need carried out under section 9 of the Housing Act, 1988. It is a matter for individual authorities to determine whether persons comply with the requirements for inclusion in an assessment. Authorities have been advised, in guidelines issued by my Department, that applicants should not be debarred from inclusion in an assessment by virtue solely of their marital status.
