Ceist:

36 Miss Quill asked the Minister for Agriculture, Food and Forestry the Government's response to a European Court ruling which stated that a 1994 EU law which set allowable limits on pesticide pollution for surface water was illegal; and if he will make a statement on the matter. [17919/96]

The Court of Justice annulled Council Directive 94/43/EC of 27 July 1994 which established uniform principles for the evaluation and authorisation of plant protection products to be placed on the market under Directive 91/441/EEC. The court found that the proper legislative procedures had not been adhered to in the adoption of the uniform principles.

While this country already implements Directive 91/414/EEC, I will be encouraging the Commission to reintroduce proposals for uniform principles to apply throughout the Union for consideration by the Council of Ministers at an early date.
