101 Kathleen Lynch asked the Minister for Justice if the new prison regulations have been implemented; the way in which they are to be enforced; and if she will make a statement on the matter. [19493/96]

Draft new prison rules prepared by my Department were published in the policy document The Management of Offenders — a Five Year Plan in 1994. The new rules are intended to replace the 1947 rules for the government of prisons. In order to avoid any possible ambiguity relating to my power to make these rules, a provision has been placed in the Criminal Justice (Miscellaneous Provisions) Bill, 1996, to provide for the making of such prison rules by the Minister for Justice, with the approval of the Government. My Department is, at present, in consultation with the Attorney General's office about the draft rules. When the draft has been finalised I will bring it before the Dáil Select Committee on Legislation and Security for discussion.
