50 Mr. Kenneally asked the Minister for the Environment the proposals, if any, he has in relation to that part of Sallypark, Waterford city, which is not covered by a proposed compulsory purchase order, in view of the detrimental effect it will have on the residents remaining and the effect on local small business; and if he will make a statement on the matter. 51 Mr. Kenneally asked the Minister for the Environment the current position in relation to the compulsory purchase order on property in Sallypark, Waterford city; and if he will make a statement on the matter. [19621/96]

I propose to take Questions Nos. 50 and 51 together.

A public local inquiry into objections received against confirmation of the compulsory purchase order referred to and into the propriety of confirming the order in so far as it relates to the extinguishment of a public right-of-way, was held on 23 July 1996. Waterford Corporation also applied to me for approval on environmental grounds to the proposed Newrath Road-Sallypark realignment scheme and submitted an environmental impact statement in this regard. I understand evidence was given at the public inquiry on,inter alia, the likely effects on the environment of the Sallypark area of the proposed road development. The corporation has also applied to my Department for an additional extinguishment of public right-of-way in connection with this proposed development.
I will give a decision on these matters as soon as possible. As my role in determining them is of a quasi-judicial nature, it would not be appropriate to comment further at this stage.
