Ceist:

37 Mr. N. Treacy asked the Minister for the Environment the reason car drivers, whose licences are endorsed while still in date and whose endorsements run out during the five year life of the driving licences, are being penalised by having this endorsement transferred to the new five year licence in spite of the fact that the endorsement may be over five years old when the licence is being renewed; his views on whether this is a fair and equitable situation; the laws governing this practice; if he will ensure that this anomaly is removed; and if he will make a statement on the matter. Section 37 (2) of the Road Traffic Act, 1961, as amended by section 49 (1) (f) of the Road Traffic Act, 1994, provides that a person whose driving licence has been endorsed is entitled to a licence free from endorsement following a period of three years calculated to take account of either continuous or discontinuous periods during which such person held a licence so endorsed. If the Deputy supplies particulars of any specific case he may be concerned with, I will have the matter further investigated.
