127 Ms O'Donnell asked the Minister for Justice the outcome of the investigation into the collapsed extradition of a person (details supplied) due to defective documents being presented to the court; and if she will make a statement on the matter. [21459/96]

128 Ms O'Donnell asked the Minister for Justice the status of the second warrant to extradite a person (details supplied) to Britain; the status of charges he faces in this jurisdiction; the reason for the delay in processing the pending extradition; and if she will make a statement on the matter. [21460/96]

I propose to take Questions Nos. 127 and 128 together.

I have already given a full report to the House on the outcome of the Garda inquiries in this extradition case.

My reply to the Deputy's question of 21 May, 1996 as reported at columns 1665 to 1667 of the Official Report indicated that the outcome of the Garda inquiries in this matter was that the original warrant was mislaid by the gardaí and that the only explanation was that it was destroyed accidentally when copies of the warrant were being made.

I also made a comprehensive statement to the House on this matter on 23 May, 1996.

As regards Question No. 128, in the light of the exceptional circumstances of this case, I informed the House in the course of my statement on 23 May, 1996 that the warrant in question was endorsed and available for execution. I am informed by the Garda authorities that the warrant will be executed, when appropriate, following the conclusion of court proceedings in this jurisdiction against the subject of the warrant. The present position regarding those proceedings is that, following the granting of an injunction by the High Court on 13 November, 1996 which prevented the proceedings from being heard in the Special Criminal Court on that date, the accused is remanded in custody to appear before the Special Criminal Court on 14 January, 1997.
