297 Mr. Gregory asked the Minister for Justice the plans, if any, the Garda have to seize mobile phones or to counter this problem in view of the widespread public use of mobile phones by persons specifically for the purposes of drug dealing. [22271/96]

A mobile phone which is the property of a person convicted under the Misuse of Drugs Act, 1977 may be forfeited by the court if the court is satisfied that such mobile phone relates to the offence for which that person has been convicted.

I have been informed by the Garda authorities that items of property, including mobile phones, used in the commission of crime can be seized in the course of an investigation for evidential purposes.
