132 Mr. J. Walsh asked the Minister for Agriculture, Food and Forestry if payment of the full amount of the second stage of REP scheme will be made to a person (details supplied) in County Cork. [7247/97]

The REP scheme includes provision for compliance checks prior to the making of second year payments. A compliance check was carried out on the applicant's farm. A problem was uncovered as a result of this check and a 25 per cent penalty was imposed. The applicant has appealed the imposition of this penalty to my Department's appeal committee on REPS. His case is currently under consideration and, when a decision is made, he will be informed of the outcome.

As a result of a compliance check in this case, a penalty was imposed on the applicant for his failure to comply fully with the terms of the scheme. This decision has been upheld by the Department's appeals committee on REPS.
