266 Mr. Gregory asked the Minister for Social Welfare if he will have arrangements made for a decision to be reviewed on a means test for the disabled person's maintenance allowance of a person (details supplied) in Dublin 8 in view of the fact that her only other income is a United Kingdom orphan's allowance. [13771/97]

Generally speaking, a person cannot receive two social welfare payments concurrently and, where they have an entitlement under two schemes, they would normally receive whichever is the higher.

It is possible to receive a United Kingdom orphan's allowance concurrently with disability allowance. In that event, however, the orphan's allowance must be assessed as means for the purposes of disability allowance. The person concerned is in receipt of disability allowance at the rate of £9.50 per week in addition to her orphan's allowance.

If the person concerned is dissatisfied with the decision in her case, she may appeal to the Social Welfare Appeals Office for an adduction of the case. She was notified of her right to appeal on 7 April 1997.
