61 Mrs. T. Ahearn asked the Tánaiste and Minister for Enterprise, Trade and Employment the reason the cost of a casual open-ended licence for trading has increased dramatically in view of the case of a person (details supplied) in County Waterford; and if she will make a statement on the matter. [16358/97]

Casual trading is governed by the Casual Trading Act, 1995 which devolved the regulation and licensing of casual trading from the Minister for Enterprise, Trade and Employment to local authorities. The 1995 Act was introduced to achieve greater efficiency and flexibility than was possible under the previous 1980 Casual Trading Act.

Section 6 of the new Act provides general powers and flexibility to each local authority to make by-laws in relation to the control, regulation, supervision and administration of casual trading within its own functional area, including the fixing of fees.

It is open to persons aggrieved at the level of fees charged for licences to raise the matter directly with their local authority.
