Ceist:

90 Mr. O'Malley asked the Tánaiste and Minister for Enterprise, Trade and Employment the number of casual trading licences issued by each local authority since the Casual Trading Act, 1995 came into effect, including licences issued under the 1980 Act; the local authorities which have brought in by-laws under the provision of section 6 of this Act; and the arrangements, if any, in place in those local authorities which have not brought in by-laws under the provision of section 6 of this Act. As there is no statutory requirement under the 1995 Act for local authorities to inform me of the number of licences issued by them, it is not possible for me to state the number of licences they have issued since that Act came into force on 1 May 1996. No licences have been issued under the 1980 Act by my Department since then. While there is no statutory requirement in the Act requiring them to inform me of their actions, I am aware that many local authorities have introduced by-laws but some remain to do so. Under the 1995 Act, it is a matter for each local authority, it being a reserved function of elected members, to introduce such by-laws.
