61 Mr. Hayes asked the Tánaiste and Minister for Enterprise, Trade and Employment the number of prosecutions which have been taken under the health and safety legislation in each of the years from 1995 to September 1997; the number of convictions which have been made by the courts in this regard; and the level of fines, if any, which have been collected in each of the years. 88 Mrs. Owen asked the Tánaiste and Minister for Enterprise, Trade and Employment the number of prosecutions which have been taken under the health and safety legislation in each of the years from 1995 to September 1997; the number of convictions which have been made by the courts in this regard; and the level of fines, if any, which have been collected in each of the years. [21969/97]

I propose to take Questions Nos. 61, 64 and 88 together.

The number of prosecutions taken for each of the years 1995 and 1996 was 24 and 35, respectively. The number of prosecutions taken for the period up to September 1997 is 25. The number of convictions for the years 1995 and 1996 was 23 and 27, respectively. The number of convictions for the period up to September 1997 is 21.
The total fines imposed for 1995 and 1996 were £13,440 and £19,600 respectively and for the period up to September 1997 total fines amounted to £18,550. I should point out however that my Department has no function in relation to the collection of fines.
