Vol. 486 No. 6

Written Answers. - Rights of Non-Nationals.

Bernard J. Durkan

Ceist:

277 Mr. Durkan asked the Minister for Justice, Equality and Law Reform whether non-nationals entering this country, both citizens of member states of the EU and otherwise, are currently given treatment in accordance with human rights standards. [22457/97]

Persons entering this country are required to meet certain entry requirements set out in law. Immigration officers, at the principal points of entry to the State, are members of the Garda Síochána, are responsible for controls on entry and have instructions on the proper exercise of their functions within the law and the Garda disciplinary code. These instructions also include procedures for recognising and dealing with possible claims for asylum made by persons arriving at points of entry.

While a small number of complaints have been made to me, and I am also aware that the Garda Síochána Complaints Board from time to time receives a small number of complaints, arising out of alleged incidents of discourtesy at sea and airports, I am not aware of any treatment of persons entering the State which would not be in accord with proper human rights standards. If the Deputy has any such information the appropriate course would be to bring the matter to the attention of the Garda Síochána Complaints Board.
