Written Answers - Special Education Needs.

268 Mr. O'Shea asked the Minister for Education and Science if he has satisfied himself that the Education (No. 2) Bill is compatible with the O'Donoghue High Court judgment; and if he will make a statement on the matter. [5540/98]

I am satisfied that the Education (No. 2) Bill is compatible with the High Court judgment referred to by the Deputy.

The purpose of the Bill is to establish the legislative framework which will underpin the future operation of the education system. As stated in its title, the Bill seeks to make provision in the interests of the common good for the education of every child in the State, including any child with special educational needs. Section 6 of the Bill sets out a series of fundamental objectives including the promotion of equality of access to and participation in education and the promotion of the means whereby students may benefit from education. Section 9 of the Bill addresses the functions of a school and includes the duty of ensuring that the educational needs of all students, including those with special educational needs, are provided for.
I am satisfied that the above measures, which encompass the needs of children with severe or profound mental handicap, are fully compatible with the O'Donoghue High Court judgment in relation to such children.

269 Mr. O'Shea asked the Minister for Education and Science when funding will be made available for equipment for five classrooms for children with special needs at St. Vincent's Hospital, Lisnagry, County Limerick; and if he will make a statement on the matter. [5541/98]

My Department recently provided grant aid of £47,275 towards regular and special furniture at St. Vincent's special school, Lisnagry.
