Michael Creed

Ceist:

147 Mr. Creed asked the Minister for Agriculture and Food if he will have arrangements made for the payment to a person (details supplied) in County Cork of his 1997 sheep headage grant. [14066/98]

The herdowner lodged an appeal on 21 October 1997 concerning his 1997 ewe premium sheep headage application. Appeals are dealt with in the order in which they are received and require individual examination. This appeal will be examined shortly and the herdowner will be notified of the outcome.

148 Mr. Creed asked the Minister for Agriculture and Food the reason a person (details supplied) in County Cork is not being paid his 1998 special beef premium application on 22 animals; and if, in view of the consequences of reapplying on certain animals with regard to extensification entitlements, he will refer the file to the appeal office for further consideration. The person named applied for 22 animals under the February 1998 22 month special beef premium scheme. Under the relevant EU Regulations governing the special beef premium scheme, payment of 60 per cent of premium entitlement cannot be made until on or after 1 November 1998 with any balance payable in 1999.

149 Mr. Creed asked the Minister for Agriculture and Food if he will have investigations made of the circumstances surrounding a person's entitlements to extensification for 1996 and 1997, which have been significantly reduced and denied in view of the difficulty with an 1996 beef premium application which was subsequently amended and partially included in 1997 at the direction of his office in Portlaoise; if he will refer this case to the appeals mechanism; and if he will make a statement on the matter. The person named submitted an application during 1996 under the special beef premium scheme which contained certain inaccuracies on foot of which a two year exclusion from the scheme was decided. During the course of the appeals procedure the penalty was reduced to a one year exclusion. The person named was advised that, for his own benefit, applications lodged after the application which gave rise to the proposed exclusion from the scheme were not admissible in 1996, but could be submitted in 1997. Following further consideration of the case and in the light of additional evidence presented by the person named it was decided that the penalty to be applied should only affect the application in question.

Therefore, the reduction in 1996 extensification premium referred to by the Deputy, concerns the animals contained in the applications which the person named was advised were not eligible to be submitted for premium until 1997 rather than in 1996. Similarly, the inclusion of these applications in 1997 has implications for that year's extensification premium. These applications will now be re-examined as part of an overall review of the extensification premium entitlements of the person named for 1996 and 1997.
