104 Mr. D. Moynihan asked the Minister for Justice, Equality and Law Reform the progress, if any, made in relation to the criminalisation of the possession and dissemination of child pornography; and if he will make a statement on the matter. [15360/98]

The Child Trafficking and Pornography Bill 1997, which I presented to this House in December 1997, was passed by the Seanad on Tuesday, 23 June 1998.

Under section 5 of the Bill, any person convicted on indictment of knowingly producing, distributing, printing, publishing, importing, exporting, selling or showing child pornography will be liable to a fine — for which there is no upper limit — or up to 14 years imprisonment, or both.

Under section 6 of the Bill, any person convicted on indictment of knowingly possessing child pornography will be liable to a fine of not more than £5,000 or up to five years imprisonment, or both.
