Ceist:

229 Mrs. Owen asked the Minister for Justice, Equality and Law Reform the position with regard to the order made in June 1997 under the Aliens Act, 1935; and if this order has been over-taken by the Dublin Convention. [16836/98]

The Aliens (Amendment) (No. 3) Order, 1997 is not affected by the Dublin Convention (Implementation) Order, 1997 and remains in force. The Deputy may have in mind the special arrangement whereby, following the Aliens (Amendment) (No. 3) Order coming into operation on 29 June 1997, persons arriving from the UK who were refused entry on statutory grounds and subsequently sought asylum had their cases considered and, where it was warranted, such persons were informed that their application should be pursued in the UK with the agreement of the authorities there. These arrangements have been superseded by the Dublin Convention, which came into effect on 1 September 1997. Persons refused leave to land under the Aliens (Amendment) (No. 3) Order 1997 who then apply for asylum are now dealt with in accordance with the convention's provisions, as they would be had they arrived from any other location.
