Ceist:

283 Mr. Gormley asked the Minister for Social, Community and Family Affairs the number of civil court proceedings currently in progress in which he has been named as the principal respondent; and if he will make a statement on the matter. [20035/98]

The number of civil court proceedings in progress in which my Department has been named as defendant is 21.

These proceedings date from January 1989 onwards with the most recent proceedings being instituted in June 1998.

Ten of these proceedings are seeking judicial reviews or challenging the constitutionality of the legislation in relation to decisions on entitlement to social welfare benefits.

One is an action in TORT seeking damages in relation to non-payment of a social welfare allowance and the remaining ten cases relate to personal injury claims for accidents occurring on the Department's premises.
