Vol. 496 No. 1

Written Answers. - Trust Funds Investment.

Pat Carey

Ceist:

194 Mr. P. Carey asked the Minister for Justice, Equality and Law Reform if he will recommend to the courts that they seek the best possible return for minors from the financial institutions in view of the very low return earned by court financial awards to minors; and if he will make a statement on the matter. [22151/98]

The Trustee (Authorised Investments) Act, 1958, provides for the investments in which trust funds may be invested and for the investment in those investments of money under the control or subject to the order of any court. The Act of 1958 also provides that the Minister for Finance may by order vary by addition or deletion the investments in which trust funds may be invested.

It is a matter for a court to decide, within the provisions of the Act of 1958 and any order made thereunder by the Minister for Finance, the appropriate investment in respect of any money under its control. I have no function in the matter. I understand, however, that while courts seek to get the best possible return on investments they are also very conscious of the need for making safe investments.
