218 Mr. Kirk asked the Minister for Finance if an application for a primary medical certificate under the disabled drivers and passengers scheme will be re-examined for a person (details supplied) in County Louth. [26459/98]

The regulations require that a disabled person meet the specified medical criteria and be in possession of a primary medical certificate issued by the appropriate senior area medical officer. Refusal of a primary medical certificate may be appealed to the Disabled Drivers Medical Board of Appeal, an independent board, whose decision is final.

It is understood from information received from the Revenue Commissioners that the issue of a primary medical certificate was refused in this instance and the person concerned appealed this refusal to the Disabled Drivers Medical Board of Appeal. The person was assessed by the board on 9 October 1998. The board confirmed that the person did not meet the medical criteria required for the issue of the primary medical certificate. Without this certificate, the Revenue Commissioners cannot consider an application for relief under the regulations.
