Ceist:

214 Dr. Upton asked the Minister for the Environment and Local Government his views on complaints (details supplied) regarding the housing development at Kimmage Manor, Dublin 6W; if he will meet residents to discuss their concerns; and if he will make a statement on the matter. [26993/98]

The issues raised are a matter for South Dublin County Council. Complaints about lack of enforcement of planning conditions can be pursued with the council, at official level or through the elected members, or with the Ombudsman. It is, of course, also open to any individual or group to seek an order in the High Court or the Circuit Court under section 27 of the Local Government (Planning and Development) Act, 1976 as amended, requiring compliance with conditions laid down in a planning permission. The adequacy of entrances and exits on to roads is also a matter for the council.

Under section 20 of the Local Government (Planning and Development) Act, 1963, the making and varying of a development plan is a matter for the planning authority. Any variation to the plan must be undertaken in accordance with the provisions of sections 21 and 21A of the 1963 Act, including the need for public consultation in relation to any such variation.

In the circumstances, it would not be appropriate for me to meet the residents involved.
