Ceist:

434 Mr. Durkan asked the Minister for Social, Community and Family Affairs the means which were not disclosed in a case of a person (details supplied) in County Kildare in respect of her application for unemployment assistance; the way in which it has been determined that she and her landlord are cohabiting when no evidence exists; if the case will be referred to another investigating officer; and if he will make a statement on the matter. The person concerned applied for unemployment assistance on 7 September 1998 having previously had her one-parent family payment disallowed on the grounds that she was cohabiting with another person. Following an investigation of her case her claim for unemployment assistance was disallowed on the grounds that her means, in particular the earnings of the person with whom she was cohabiting, had been disclosed in full as required by the Social Welfare Acts.

An appeal hearing was held on 12 February 1999 and the appeals officer upheld the original decision. An appeals officer's decision is final in the absence of new facts and-or fresh evidence.
