Vol. 508 No. 1

Written Answers. - Family Law Legislation.

Alan Shatter

Ceist:

444 Mr. Shatter asked the Minister for Health and Children the number of notices of intention to marry pursuant to the Family Law Act, 1995, furnished to marriage registrars to date by persons intending to marry who, at the date of the furnishing of this notice, are already married and awaiting the granting of a divorce decree. [17516/99]

The administration of the marriage Acts is statutorily a matter for An tÁrd Chláraitheoir, the Registrar General. The information requested by the Deputy would not be in the possession of An tÁrd Chláraitheoir as, although persons are required under section 32 of the Family Law Act, 1995, to give three months notification of intention to marry, they are not specifically required by that section to provide information of the nature referred to by the Deputy.

To contract a valid marriage in this State, the parties to that marriage must have full capacity to marry each other on the date of the marriage.
