249 Mr. Killeen asked the Minister for the Environment and Local Government if, further to Parliamentary Question No. 300 of 5 October 1999, he will satisfy the requirement for student accommodation under section 50 of the Finance Act, 1999; and if it will apply to buildings commencing before the announcement of definite proposals relating to Part M. [19807/99]

As I stated in my reply to Question No. 300 on 5 October 1999, Part M of the building regulations, when amended, will apply to new dwellings, commencing on or after the 1 July 2000. The amended Part M will not apply to dwellings commenced prior to that date. However, the existing Part M applies to public buildings and common areas of apartment blocks commenced on or after 1 June 1992.

Requirements relating to the student accommodation scheme and criteria for tax incentives under Section 50 of the Finance Act, 1999, are primarily matters for the Minister for Education and Science, in consultation with the Minister for Finance.
