296 Mr. Perry asked the Minister for the Environment and Local Government if a favourable decision will be made for a person (details supplied) in County Leitrim in view of the fact that he was not the holder of a licence at the time of any of his convictions and taking into consideration that he indicated on his application that he was not required by court order to carry any endorsement; and if he will make a statement on the matter. Section 37(2) of the Road Traffic Act, 1961, as amended by section 49(1)(e) of the Road Traffic Act, 1994, provides that persons convicted of certain offences must carry notice of their conviction(s) on their respective driving licences by way of endorsement for a minimum period of three years, which can be continuous or discontinuous. The Act also provides that where a convicted person is not the holder of a current licence at the time of a conviction, the details of such conviction must be endorsed on the next licence granted to that person.

It would not be appropriate for the Minister for the Environment and Local Government to comment on individual cases involving the administration of these provisions, responsibility for which rests with local licensing authorities.
