Ceist:

140 Mr. Timmins asked the Tánaiste and Minister for Enterprise, Trade and Employment if her attention has been drawn to the fact that a company (details supplied) has initiated a policy of not renewing licences for several family run premises; if this company gave her any undertaking that it would adhere to certain practices when they entered the market; her views on this reported development; the plans, if any, she has in this regard; and if she will make a statement on the matter. My attention has not been drawn to the problem identified by the Deputy.

The Competition Authority motor fuels category licence, which applies to suppliers of motor fuels and their tied service station retailers, covers agreements for the retailing of motor fuel. The licence was drawn up and is overseen by the independent Competition Authority and any complaints regarding the operation of the licence should be directed to them.
The particular company referred to by the Deputy entered the Irish market following its acquisition of BP Ireland Limited in 1992 and no undertakings were sought or given. If, however, the parties to which the Deputy refers, qualify as commercial agents under Council Directive No. 86/653/EEC, they can seek the protection afforded by the European Communities (Commercial Agents) Regulations which are outlined in SI 33 of 1994 as amended by SI 31 of 1997. These regulations provide protection when a principal withdraws from a written agreement entered into between the principal and the com mercial agent, and they entitle a commercial agent to compensation when such a contract is ended.
