489 Proinsias De Rossa asked the Minister for Justice, Equality and Law Reform the number of cases where files have been referred to the DPP for possible prosecution under the Prohibition of Incitement to Racial, Religious or National Hatred Act, 1989; the number of cases in respect of which prosecution were initiated; and if he will make a statement on the matter. 494 Mr. Quinn asked the Minister for Justice, Equality and Law Reform the number of prosecutions brought under the Prohibition of Incitement to Racial, Religious or National Hatred Act, 1989; and if he will make a statement on the matter. [12964/00]

I propose to take Questions Nos. 489 and 494 together.

I am informed by the Garda authorities that during 1998 one case involving an alleged breach of the Prohibition of Incitement to Hatred Act, 1989, was referred to the DPP. The case was subsequently dismissed in the District Court. Comparable statistics for 1999 and 2000 are operational/provisional and are not yet available.
