73 Mr. Connaughton asked the Minister for Agriculture, Food and Rural Development the reason a 1999 REPS payment was made to a person (details supplied) in County Limerick; and if he will make a statement on the matter. [14770/00]

The person named has completed five years in the REP scheme and has received five annual payments. He has been invited to apply for a sixth transitional payment and the application will be processed in the usual way if and when it is received.

The fifth year payment for the person named has been the subject of a 50% penalty for a discrepancy between the areas declared in area aid and in REPS. The penalty is currently under appeal and a report has been sought from my Department's regional inspector. When the report has been received the matter will be placed before the REPS appeals committee.
