Written Answers. - Arterial Drainage Schemes.

441 Mr. Higgins (Mayo) asked the Minister for Finance if the Office of Public Works will be prepared, under the Arterial Drainage (Amendment) Act, 1995, to carry out maintenance work on a tributary of the River Moy (details supplied). [19297/00]

In 1971 the Commissioners of Public Works completed the Moy catchment drainage scheme under the Arterial Drainage Act, 1945. Under the terms of this Act, they are statutorily obliged to maintain the works in proper repair and effective condition.

The tributary in question does not form part of this scheme and the commissioners are precluded from carrying out any maintenance works there. This tributary was considered for inclusion at the time of the scheme but was omitted on economic grounds. The costs involved in carrying out the works are still uneconomical and consequently the Commissioners of Public Works have no plans to carry out work on the tributary under the Arterial Drainage (Amendment) Act, 1995.
