Ceist:

100 Mr. O'Shea asked the Tánaiste and Minister for Enterprise, Trade and Employment if an appeal has yet been lodged against the High Court judgment of 28 July 2000 overturning her appointment of an authorised officer to two companies (details supplied); and if she will make a statement on the matter. [26572/00]

On 31 October last a 14 point notice of appeal was lodged with the Supreme Court by the Chief State Solicitor seeking orders that the authorised officer was validly appointed and that his request for books and documents was a valid exercise of his powers.

I understand the legal representatives of Dunnes have also lodged a cross-appeal with the Supreme Court seeking an order affirming Mr. Justice Butler's judgment of 28 July 2000. I am seeking an early hearing of the case.
