139 Mr. Durkan asked the Minister for Agriculture, Food and Rural Development if he will further review the various applications for cow and heifer premiums which were previously refused in the case of a person (details supplied) in County Kildare; if similar applications in similar circumstances have been approved; and if he will make a statement on the matter. The person named applied for suckler cow premium on 70 animals under the 1991 suckler cow premium scheme on 29 May 1991. At an inspection which took place on 1 October 1991 it was found that 11 of the animals listed on the application were deemed to be uncalved heifers and consequently his declaration was deemed false as heifers were not acceptable under the 1991 suckler cow premium scheme.

In accordance with the regulations governing the scheme in question the person named was not entitled to suckler cow premium in 1991 and was also debarred from the 1992 suckler cow premium scheme.

This case has been reviewed on numerous occasions and the decision regarding non-payment of grants cannot be changed when consideration is taken of the regulations governing the scheme.

Any claim where the applicant is deemed to have made a false declaration as is the case in question has a penalty applied as defined by the regulations which is exclusion from the scheme for the year in question and the following scheme year.
