86 Mr. Higgins (Mayo) asked the Minister for Agriculture, Food and Rural Development if he will consider inserting advertisements in the local and national press to establish the number of farmers who were denied milk quota due to animal disease difficulties after quotas were introduced. [30229/00]

In November 1984 my Department published a notice announcing the establishment of a reserve for the allocation of additional milk quota to producers whose milk deliveries during 1983 were restricted due to animal disease or certain other exceptional factors. This notice and a further one in January 1985 invited applications from producers who wished to receive an allocation from the reserve. All of that reserve was allocated to eligible applicants.

I do not propose to have further notices published on this matter.

87 Mr. Higgins (Mayo) asked the Minister for Agriculture, Food and Rural Development the total cost to his Department of defending claims in the courts brought by farmers who had been denied milk quota but who were subsequently found by the courts to be entitled to them. [30230/00]

The question of costs in the case referred to by the Deputy is before the courts at present and a date for hearing is awaited.
