Ceist:

220 Mr. Higgins (Dublin West) asked the Minister for Justice, Equality and Law Reform if an investigation was conducted by a member of the Garda Síochána (details supplied) in County Galway following a complaint by a person (details supplied) in County Galway concerning an assault on him at a night club in Galway on 30 May 1998; and the findings of the Garda investigation in this regard. I am informed by the Garda authorities that the person referred to by the Deputy alleged to the Garda Síochána that he was the victim of an assault at a night club on 30 May 1997. The allegation was subsequently investigated and the directions of the DPP were sought.

I understand proceedings were commenced by way of summons, and the case first came before the District Court on 13 May 1998. The case was adjourned on several occasions, and finally on 2 December 1998 the District Court judge dismissed all the charges against the person referred to and the other parties in the case.

The Judiciary are independent in the exercise of their functions and it would not be appropriate for me to comment on the matter.
