426 Ms Cooper-Flynn asked the Minister for Education and Science the rate of pay of a person (details supplied) in County Mayo; if temporary assistant teachers received payment for bank holidays and school holidays; if such teachers are entitled to be paid for days when children, who are assigned to them, are absent from school; and the holiday entitlements of a temporary assistant teacher. I understand the person referred to by the Deputy is employed as a part-time special needs assistant in a primary school and that the information requested by the Deputy relates to the entitlements of special needs assistants.

The rate of pay applicable to the post in question is currently £5.81 per hour. Part-time special needs assistants are contracted to deliver a specified number of hours service per week in the schools in which they are employed and are paid accordingly without reference to occasional non-attendance by pupils in their care.

Under current legislation 8% of total earnings is paid to each part-time special needs assistant in respect of holiday pay. Also under current legislation, a part-time worker must have worked at least a total of 40 hours in the five weeks immediately before a public holiday in order to be entitled to payment for the public holiday.
