128 Mr. N. O'Keeffe asked the Minister for Justice, Equality and Law Reform the proposals he has in the context of the foot and mouth disease crisis to deal with stray animals, particularly horses and goats, associated with illegal encampments. [10294/01]

The Diseases of Animals Acts 1966 to 2001 confer substantial powers on the Minister for Agriculture, Food and Rural Development to take appropriate measures to prevent the spread of disease. The Control of Horses Act, 1996 empowers local authorities to seize and detain wandering horses. In relation to combating the foot and mouth disease outbreak, additional measures are being taken by the Minister for Agriculture, Food and Rural Development. Garda are playing their part along with all the other relevant agencies in dealing with foot and mouth disease.

In relation to the lands of the state agency referred to by the Deputy, I have referred that matter to the relevant Department. Land owners also have a responsibility to ensure that stray animals do not venture onto their lands and to secure their boundaries.

Statutory powers conferred on An Garda Siochana in relation to the control of stray animals are utilised in appropriate cases.
