Written Answers. - Road Traffic Accidents.

Ceist:

323 Mr. Noonan asked the Minister for Justice, Equality and Law Reform if he will release all documentation relating to the death in 1972 of a person (details supplied) when she was hit by a car in the service of the Garda Síochána; if any compensatory amount was paid to the next of kin; and if he will make a statement on the matter. [14781/01]

Records in my Department show that this case concerns a fatal road traffic accident that occurred involving a Garda car and an elderly female pedestrian. Circuit Court proceedings were subsequently initiated by the deceased's next of kin through his legal representatives. A monetary amount lodged in court by the State was accepted by the deceased's next of kin. The legal costs incurred by the next of kin's legal representatives, as taxed by the Chief State Solicitor's office, were also paid.

The Deputy will appreciate that I would be reluctant to agree to release official records without first being aware of the identity of the person who is seeking the records and his or her relationship to the person about whom the records are held. I can, however, confirm to the Deputy that I am prepared to consider any request from a person with a legitimate interest for access to the records held by my Department in relation to the accident.
