Ceist:

170 Mr. Cosgrave asked the Minister for the Marine and Natural Resources if he is concerned with the reports that part of the Dún Laoghaire marina is in breach of a planning decision; the discussions which have taken place subsequently with the harbour board; if he has any proposals regarding the present situation; and if he will make a statement on the matter. I am not aware that the marina as constructed breaches planning permission. If this is the case it is a matter between the harbour company and the planning authority. The first phase of the marina, which I recently opened, slightly exceeds the area allowed under the terms of the foreshore lease issued by my Department following approval by me. I am satisfied that this was not intentional and that it does not interfere with navigation or cause environmental problems. It is, therefore, purely a landlord and tenant issue and my Department has put certain proposals to the harbour company to deal with the matter and regularise the situation.
