157 Mr. Deasy asked the Minister for Arts, Heritage Gaeltacht and the Islands if her attention has been drawn to the threat to the habitat and nesting area of the kittiwake colony at the cliff face on the inner harbour in Dunmore East, County Waterford; and the action she is taking to ensure the protection of this colony. [27385/01]

I am aware of this case which refers to a planning application submitted to Waterford County Council by the Department of the Marine and Natural Resources for permission to carry out remedial works associated with the stabilisation of two cliff faces at Dunmore East, County Waterford. I understand that these proposed works are considered necessary for health and safety reasons.

Waterford County Council referred this application to my Department which, following consideration of the information provided, recommended last month a number of mitigating measures regarding the development and its potential threat to the kittiwake colony. I will arrange for a copy of the Department's reply to the county council to be sent to the Deputy. The matter currently rests with the council and I understand that they have now requested further information in relation to the proposed works from the Department of the Marine and Natural Resources.
